Sketch design stage in Morocco: legal checks before the first drawing

In Morocco the sketch design is the moment when the brief meets the rules of the plot. Before any layout is drawn, the owner's brief and budget ceiling are put in writing, the architect is appointed under a written contract, as Law 016-89 and urban planning Law 12-90 require for most buildings, and the land title is checked. The zoning information note then gives the local development plan rules, while the seismic zone of the municipality, the coastline law and the heritage law can restrict what is buildable. Only then are layout options compared and one is chosen in writing.

Scope

This page covers the earliest design stage of a house, a small apartment building or a facility: the written brief, the architect's appointment, the land and title checks, the zoning information note, the topographic survey and, when it is needed early, the geotechnical survey, up to the choice of one sketch option. It lists the texts that decide whether the project is possible at all, not the technical rules used later to size the building.

The stage opens with the owner's first expression of need and closes when the client approves one sketch option in writing. Everything that fixes floor areas, a cost estimate per trade and the general appearance belongs to the preliminary design stage that follows.

Who does what

PartyRole
Client (owner)States the brief and the all-inclusive budget ceiling, proves ownership of the plot, signs the architect's contract and approves the chosen sketch in writing.
ArchitectChecks the title and the zoning information note, reads the local plan, assesses feasibility, then proposes and explains several layout options within the buildable envelope.
Registered surveyorProduces the topographic survey tied to the land title and records any mismatch between the title plan and the plot on the ground.
Geotechnical engineer and structural engineerWhen the site or the programme calls for it, characterise the soil early so that basements and foundations do not invalidate the chosen sketch.
Urban agency and municipalityIssue the zoning information note and, where relevant, the prior opinions on flood risk, coastline, heritage or classified roads.

Inspection milestones

  1. Brief and budget ceiling Good practice
Brief sheet completed with rooms, levels, standard and target date, plus a budget ceiling that includes fees, permits and taxes.
  2. Architect's contract signed Legal obligation
Signed architect's contract stating the missions covered, the fee and its payment schedule; a hold point before any design work.
  3. Land title checked Legal obligation
Recent certificate of ownership and title plan on file, with written consent of any co-owners.
  4. Zoning information note obtained Legal obligation
Zoning information note obtained and read against the plot: zone, height, number of storeys, coverage, setbacks and any special constraint.
  5. Feasibility approved by the client Specification (CPS) requirement
Feasibility note shared with the client, stating what can be built, the approximate cost and the constraints, and approved before drawing.
  6. Sketch design chosen Good practice
Several layout options presented and one approved in writing by the client.

Common non-conformities and follow-up

FindingAction
The title plan and the survey disagree on the plot boundaries.Freeze the sketch, ask the surveyor for a boundary reconciliation and settle it with the land registry before designing on uncertain limits.
The client's brief exceeds what the local plan allows on the plot.Show the client the buildable envelope, reduce or reorganise the programme, and record the revised brief in writing.
The plot is near the shore or within a protected heritage area and this was discovered late.Obtain the specific opinion or authorisation required before continuing, and adapt the sketch to the conditions set.
Design work started without a signed architect's contract.Stop and formalise the engagement: missions, fee and schedule must be agreed before any drawing is handed over.

Frequently asked questions

Which documents should I gather before the sketch design?

Proof of ownership with the title plan, the zoning information note for the plot, a topographic survey by a registered surveyor and, for difficult soils or basements, an early geotechnical survey.

Is an architect compulsory from the sketch stage?

Urban planning Law 12-90 requires an architect for most building permits, and the sketch is the first part of that mission. Appointing the architect under a written contract from the start avoids redrawing later.

Does the seismic zone matter at sketch stage?

Yes. The zone of the municipality, as revised under Decree 2-24-766, influences structural regularity and the cost of the frame, so it should be known before the layout is fixed.

What does the zoning information note tell me?

It summarises the local plan rules for the plot: zone, permitted height and storeys, coverage, setbacks, alignment and parking. It is the reference against which every sketch option is checked.

Can a foreign investor rely on European standards at this stage?

Foreign standards have no mandatory effect in Morocco. Planning law, the local plan and Moroccan regulations prevail; foreign references can only enter later through the contract.
