On site in Morocco: legal obligations, hold points and material checks

Once the contract is signed, a Moroccan construction site is governed by both law and contract. Law 66-12 and Decree 2-19-409 require the site opening to be declared, a site sign and hoarding, and a site logbook available to planning inspectors. Insurance under Order 3201-24 must be active, the Labour Code sets the contractor's safety duties, and Law 28-00 governs construction waste. Technically, the site moves from hold point to hold point: setting-out, excavation bottoms, reinforcement before every pour, concrete testing, waterproofing and embedded services. Reinforcing steel must carry NM certification, and nothing is cast before written acceptance.

Scope

This page covers the works from the notice to proceed to the completion of finishes and external works: site opening and set-up, setting-out, earthworks and substructure, frame and floors level by level, masonry and roof waterproofing, embedded services, finishes, equipment tests and external works, including subdivision infrastructure.

It starts with the notice to proceed and stops when equipment has been tested and the building is ready for the pre-handover inspection. The trade-by-trade requirements are detailed on the individual work package pages; acceptance, occupancy permit and guarantees are covered under handover.

Who does what

PartyRole
Client (owner)Issues the notice to proceed with the architect, keeps the insurance and permit valid and pays against measured progress.
ArchitectDeclares the site opening, supervises the works, records instructions in the site logbook, and accepts setting-out and the architectural hold points.
Structural engineer and inspection bodyAccept excavation bottoms, reinforcement and formwork before each pour, and follow the concrete test results.
ContractorBuilds to the drawings, provides material certificates, requests each acceptance in writing before closing up or casting, and runs site safety.
LaboratoryTakes concrete samples, tests them and issues the reports that the structural engineer reviews.

Inspection milestones

  1. Notice to proceed Specification (CPS) requirement
Notice to proceed signed, fixing the start date of the contract period.
  2. Site opening declared Legal obligation
Opening declared, sign and hoarding in place, site logbook opened as Law 66-12 requires.
  3. Setting-out accepted Legal obligation
Axes, setbacks and levels checked against the permit before excavation, with the surveyor's setting-out plan.
  4. Excavation bottoms accepted Specification (CPS) requirement
Bearing soil confirmed as consistent with the geotechnical report before blinding concrete.
  5. Floor slab of the level accepted, cast and tested (each level) Specification (CPS) requirement
Props, reinforcement and openings of each floor accepted before casting, samples taken, striking done at the time set by the engineer.
Standards to check at this milestone: NM 01.4.096, NM 01.4.097, NM 10.1.004, NM 10.1.008
  6. Embedded services tested before closing up Specification (CPS) requirement
Embedded plumbing pressure-tested, drains flow-tested and photographed before plaster and screeds hide them.
Standards to check at this milestone: NM 06.6.071

Common non-conformities and follow-up

FindingAction
Steel delivered without NM certificate or with marking that does not match the delivery note.Set the batch aside, require the certificate or replace it; order laboratory tests if doubt remains.
A floor was cast without written acceptance of the reinforcement.Record the event in the logbook, have the structural engineer assess the risk and decide on investigation or reinforcement in writing.
The setting-out does not respect the permit setbacks.Stop before excavation, correct the setting-out and have it accepted again; building outside the permit exposes the owner under Law 66-12.
Plumbing covered before the pressure test.Open the relevant sections, carry out the test and record it before closing again.

Frequently asked questions

What must be displayed on a Moroccan construction site?

A site sign with the permit references and the parties, a hoarding, and a site logbook kept available to inspectors, as required by Law 66-12.

What is a hold point?

A stage at which work stops until the responsible person has accepted it in writing, such as reinforcement before a pour. Once concrete is cast, errors can no longer be seen.

Who checks the steel delivered to site?

The contractor provides certificates and delivery notes; the architect, the structural engineer or the inspection body checks them against the mandatory NM standards before use.

Is the site covered by insurance?

Order 3201-24 frames the compulsory all-risks policy for the works and the ten-year liability insurance. Check certificates before starting and keep them on file.

How is construction waste handled?

Under Law 28-00 it must be removed to authorised sites. The CPS should specify sorting and evacuation, and the architect checks it during site visits.
